Judge Michael Kwan decided that he HAD TO make a political statement against President Trump, which resulted in his suspension from the bench for the next six months. Was it worth it?
A judge is supposed to be impartial, period. They should follow the law and the constitution. They should in no way show partiality. That’s why during State of The Union, the U.S. Supreme Court justices don’t applaud, except for honoring WWII veterans or other heroes.
Far too many judges express their political views in their court decisions. Absolutely nothing is done about that happening. Many arguments have been made about the turnover rate of the liberal 9th Circuit Court. More cases from the 9th Circuit reached the Supreme Court than any other Court in the land. Their turnover rate is 79%. That means that the Supreme Court finds that the Ninth Circuit was wrong over 3/4 of the time! How can that occur unless you are ignorant of the law or politicizing decisions?
A longtime Utah judge has been suspended without pay for six months after making critical comments online and in court about President Donald Trump, including a post bashing his “inability to govern and political incompetence.”
Judge Michael Kwan’s posts on Facebook and LinkedIn in 2016-2017 violated the judicial code of conduct and diminished “the reputation of our entire judiciary,” wrote Utah State Supreme Court Justice John A. Pearce in an opinion posted Wednesday.
Kwan’s Facebook account was private but could have been shared by friends, Pearce wrote.
“Judge Kwan’s behavior denigrates his reputation as an impartial, independent, dignified, and courteous jurist who takes no advantage of the office in which he serves,” Pearce said. [Associated Press]
The moment one becomes a judge, one needs to keep their political views to themselves. Not always easy to do, but if one cannot abide by the rules, then that person must resign. Once the political views are known, how are others to believe your rulings are made without bias.
Any Trump supporter sentenced, jailed, or fined by this guy need to have their cases reviewed, don’t think anyone he thought was a trump supporter didn’t get punished to the extent he could legally get away with if these are the statements he posted and words he said in the courtroom.
Hopefully, his friends and employers will realize the effect of early onset dementia! Within the next six months, he should have an examination by qualified physicians!
