Fox News Napolitano Says Matthew Whitaker “Legally Ineligible” As Acting AG

Judge Andrew Napolitano is apparently in the early stages of cognitive impairment.

It’s time for Fox to cut him loose like the rabid animal he is becoming. When I watch Fox News, I used to be happy to see Fox NewsSenior Judicial Analyst Judge Napolitano on the TV screen, but as of late, he is becoming something other than straightforward and honest.

I am not an expert in law like the judge, but it seems like every time he has something to say, it is negative toward the Trump administration. When I am on my radio show, I tell everyone that listens to me, I am not a cheerleader for the Trump administration. However, it angers me when I see somebody or a network that has a primary objective to be negative toward the Commander-in-chief.

Former Attorney Jeff Sessions is gone, and Trump selected Matthew Whitaker to take his place for now. Democrats do not want Whitaker in place because he is a straight shooter and law enforcement guy. They have been asking him to recuse himself from anything going forward. Doesn’t that sound familiar?

“I was very disappointed to see the lawyers who work for Matthew Whitaker go back to 1866, and look for a precedent there to decide whether or not he was lawfully appointed,” Napolitano said during a segment on Fox News’ “Shepard Smith Reporting.” “I don’t care what happened in 1866, because the Congress changed the law in the 1960s and said whoever runs the Justice Department has to be nominated by the president and confirmed by the Senate because we put too much power in their hands.

Napolitano served on New Jersey’s Superior Court for almost a decade in the 1980s and ’90s, and he is an expert in constitutional law and rule of law.

He said Wednesday that Republicans shared Democratic concerns regarding what Whitaker, an ally of President Trump, may do now that he oversees special counsel Robert Mueller’s federal Russia investigation.

The problem comes with decisions made by Mr. Whitaker in the interim,” Napolitano said. “Because when his position — not if — when his position is found to be legally ineligible, those decisions will become null and void. Put that toothpaste back in the tube.”

Democrats are going to mull over what Napolitano said and will probably contact him to find out more so they can use it against Trump with hearings and committee investigations.
