Rep. Nancy Pelosi and Sen. Chuck Schumer are reaching out to Republicans in a bipartisan effort in the act of preserving the Constitution with Trump’s latest move to redirect funds without asking the House of Representatives.
President Trump said that this move would be lost in the court system in the early going, but hopefully, when it gets to the Supreme Court, it will pass.
“This is plainly a power grab by a disappointed President, who has gone outside the bounds of the law to try to get what he failed to achieve in the constitutional legislative process.”
“Just as both parties honored our oath to protect the American people by passing the conference committee bill, the Congress on a bipartisan basis must honor the Constitution by defending our system of checks and balances,” they said. “The President is not above the law. The Congress cannot let the President shred the Constitution,”
Democrats and some experts feel that Trump will lose because this is an appropriation of funds move without working with Congress. Other National Emergencies didn’t do that hence the setting a new precedent, which Pelosi has been using as an example for the last couple of days.
While it is true that no other president has declared a national emergency to realign funds that Congress appropriated, this was a move President Trump was forced into because Congress wouldn’t act on providing funds to fix and finish a deteriorating border wall between U.S. and Mexico.
That’s right kiddies, the wall has been there for years so this is not new. But it is old, too short in some cases and doesn’t go deep enough in others. Mexicans, Central Americans, and others have been “climbing” over for years, and many have tunneled through.
As I said, however, moving funds without Congress consent is moving into waters not chartered but there is always a first time for everything.
I do understand that Republicans will face the same argument if a future president moves money that Congress appropriated for the military to Obamacare or declaring health care in general as a national emergency. As of now, they will have no argument or defense to stop it.
I am sure some will scoff at that notion or dismiss it because you’re living in the moment, which is fine. But that day can and will come, mark my words.
As for me, I wanted Trump to use existing law 10 U.S.C. § 284 which doesn’t need congressional approval to fund the wall but who am I again but a little voice in the wilderness.
I hope this decision, crafted by Trump’s internal team, does not come back to hurt him later, especially when it deals with getting funding for other programs he wants to work for the American people. Democrats are that resistant and remember, nearly 50 Republicans gave up their seats before the 2018 midterms to allow this to happen.
